Please read these Terms of Service ("Terms") carefully before downloading, installing, or using Phonics Race ("the App"), developed and published by Forward Alpha, LLC ("we", "us", "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. If the user is a child, a parent or legal guardian must review and agree to these Terms on the child's behalf.
Phonics Race is a free educational mobile application designed for children ages 4–6 to practice phonics skills, letter recognition, and early reading through interactive gameplay. The App is intended to supplement — not replace — reading instruction from parents, teachers, or qualified educators.
We grant you a limited, non-exclusive, non-transferable, revocable, worldwide license to download and use the App for personal, non-commercial, educational purposes on devices that you own or control. This license does not include the right to sublicense, distribute, or make the App available to third parties.
The App is designed for children ages 4–6. Children should only use the App with the knowledge and consent of a parent or legal guardian. By allowing a child to use the App, you represent that you are the child's parent or legal guardian and that you have reviewed and agree to these Terms.
All content within the App — including but not limited to text, graphics, illustrations, car designs, series names and themes, audio effects, user interface design, and game mechanics — is the exclusive property of Forward Alpha, LLC and is protected by United States and international copyright, trademark, and intellectual property laws.

We may from time to time release updates to the App to add features, fix bugs, improve performance, or address security issues. We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without prior notice. We are not obligated to provide support, maintenance, updates, or patches.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORWARD ALPHA, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
Our total liability for all claims arising from or related to the App shall not exceed the amount you paid for the App (which is zero, as the App is free).
You agree to indemnify, defend, and hold harmless Forward Alpha, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App is immediately revoked. You may terminate your use at any time by uninstalling the App.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Delaware.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward Alpha, LLC regarding the App and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
